NOEL Alimentaria, S.A.U. (hereinafter, “NOEL“), a company committed to compliance with laws and regulations and to maintaining the privacy of its customer’ data, complies with existing personal data protection law.
As a result, it has taken the necessary technical measures to maintain the required level of security, according to the nature of the personal data processed and the circumstances of the processing, in order to prevent, as far as possible and always according to the state of technology, its alteration, loss, processing or unauthorised access.
1. Purpose
Through the website www.noelalimentaria.com (hereinafter, “Website”), the User may access content and services offered by NOEL that require User interaction and the submission of personal data. The purpose of this policy is to inform data subjects who visit or use the Website (hereinafter, “Users”) about how NOEL will use their personal data.
2. What personal data do we collect?
In accordance with Article 13 of Regulation (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, which repeals Directive 95/46/EC (hereinafter, “GDPR”), and Article 11 of Organic Law 3/2018 of 5 December on the Protection of Personal Data and the guarantee of digital rights (hereinafter, “LOPDgdd”), Users are informed that data collected on the Website, through contact forms or the supplier portal, will be processed by NOEL Alimentaria, S.A.U., with registered address at Pla de Begudà, 17857 Sant Joan les Fonts (Girona), Spain, as the data controller.
For the purposes set out in this Privacy Policy, the following personal data are collected and processed:
- Identification and contact details, such as full name, email address, and telephone number.
- User data and password, for registration and access to the Supplier Portal.
- Any additional information the User shares in the free-text field included in the contact form.
3. For what purposes and on what grounds do we process personal data?
NOEL may process Users’ personal data for the following purposes:
- Responding to and managing enquiries, complaints, or requests submitted by interested parties through the forms available on the Website or by telephone contact with NOEL’s Customer Service. If the enquiry, complaint, or request relates to a product or service previously contracted, the legal basis for the processing is the performance of the contract between NOEL and the User. If it is not related to a previously contracted product or service, the processing is based on the User’s consent when contacting NOEL. The retention period of your personal data shall be until the enquiry, complaint, or request has been resolved.
- Managing the Supplier Portal, including access administration, credential validation, and fulfilment of contractual obligations. The lawful basis for this processing is the performance of the contractual relationship between NOEL and the supplier. The retention period of your personal data shall be until the contractual relationship ends and, once it ends, for the time necessary to fulfil any resulting obligations.
- Sending marketing communications about products, services, promotions, updates, or events related to NOEL’s activity, by any means, provided the User has given express consent. However, NOEL does not need to request consent when there is a prior contractual relationship and the communications concern products or services similar to those contracted. Your personal data will be retained for three years from the last interaction with NOEL or until the User expresses their wish to withdraw consent.
All processing activities mentioned above will be carried out in accordance with the principles of transparency, purpose limitation, data minimisation, accuracy, integrity, and confidentiality, as well as the obligations and safeguards established in the GDPR.
4. To whom are Users’ data disclosed?
In general, NOEL will not transfer Users’ personal data except in cases where such transfer is necessary to comply with legal obligations to which NOEL is subject or when strictly required for the execution and development of the contractual relationship with the User.
In particular, data may be shared with competent authorities and bodies, courts, tribunals, or any other third parties authorised under applicable regulations. Data may also be shared with specific service providers offering services to NOEL, such as marketing service providers. These providers act as data processors and will never process the data for their own purposes.
5. How long will Users’ personal data be retained?
Personal data will be retained for as long as necessary to fulfil the purposes for which they were collected, including compliance with any legal or informational requirements, as detailed in section 3 above.
6. Will data be subject to international transfers?
In general, Users’ personal data will not be transferred to countries outside the European Economic Area (“EEA”). If NOEL uses providers that process data outside the EEA, such transfers will be based on the signing of standard contractual clauses adopted by the European Commission for international transfers, or one of the other safeguards provided for under applicable regulations.
7. What rights can the User exercise?
The User may exercise the following rights:
- Right of access: you have the right to ask whether or not your personal data are being processed and, where appropriate, to receive a copy of the personal data processed.
- Right of rectification: you have the right to have inaccurate personal data corrected or completed if incomplete.
- Right of erasure: you have the right to request the deletion of your personal data in cases where your data is no longer required to carry out the purpose for which it was collected, when you withdraw your consent in cases where it is the basis for legitimising the processing of the data, provided that the User objects and no other reasons prevail, when your data is processed unlawfully or in cases where the erasure is in response to compliance with a legal obligation.
- Right of restriction: you have the right to request the restriction of the processing of your personal data, with the suspension or retention of your data, depending on the circumstances.
- Right to object: you have the right to object at any time, with regard to your particular situation, to the processing of your personal data.
- Right of portability: you have the right to receive the personal data you have provided in a structured, commonly used, machine-readable and interoperable format and to transfer it to another entity.
NOEL will not make any automated decisions regarding your personal data.
In addition, the User may withdraw at any time, without retroactive effect, the consent previously given to authorise the processing of his/her personal data for the purposes described.
