PRIVACY POLICY FOR JOB APPLICATIONS AT NOEL ALIMENTARIA, S.A.U.
- INFORMATION AND DATA CONTROLLER
This privacy policy aims to inform you of the personal data processing that is carried out within the framework of a job application, either generically or for a specific job, and the implementation of the selection process. The data controller is NOEL ALIMENTARIA, S.A.U. with registered offices at Calle Pla de Begudà, 17857 – Sant Joan les Fonts, Girona, with tax code A-17014713 (hereinafter, NOEL), e-mail: noel@noel.es.
You may consult any data protection matter at any time by writing to: rgpd@noel.es.
- PROCESSING PURPOSE AND LEGITIMATE BASIS
The personal data you provide, either through forms on the different channels, during the selection process, the interview (in-person or on-line), or the motivation and aptitude test, will be processed to manage the selection process and, if selected, to formalise the employment contract. The legal basis for this processing is your express consent and execution of the pre-contractual relationship.
If you wish, you can register as a member of our community of candidates (generic application), which will allow us to send you information about job offers that may interest you and keep your cv for future vacancies that fit your profile. The legal basis for this processing is your express consent. By joining the community, you accept that we consider you for other suitable vacancies at NOEL.
You can cancel your subscription to the community and revoke any other consent given at any time. To do this, you may write to the address indicated in section 8 of this document (EXERCISE OF RIGHTS).
- CATEGORY OF DATA AND DATA SUBJECTS
The personal data we process are those you give us when you register and the additional data you provide to keep your information up-to-date. This includes contact data such as name, surname(s), e-mail, company, position, landline and mobile telephone number, and other professional contact data. We also process data included in your CV, such as education, employment experience and data obtained through skills and/or knowledge tests that are necessary to assess your suitability for the job offered.
We do no intentionally process special personal data categories (health, ideologies, etc.). We expressly ask that you do not send us this data, unless the job specifically requires it. If you voluntarily provide us with this information, you accept its processing and storage as part of the selection processn caso de que nos proporciones voluntariamente esta información, aceptas.
The only data subjects whose data will be processed are the candidates for vacancies at NOEL.
- COMMUNICATION OF DATA
- a) The data collected by NOEL will not be shared with third parties, unless strictly necessary due to legal demand, such as for example, when they must be provided to Public Administrations, Courts and Tribunals.
In these cases, the processing of your personal data is done to comply with the legal obligations to which we are subject. This may imply the transfer of your data to third parties (such as, for example, public authorities) to comply with legal requirements for information, presentation of reports or disclosure. Furthermore, we may process your data to enforce, exercise or defend ourselves from legal claims, such as discrimination claims, and transfer them to third parties (such as lawyers, courts or prosecutors). The legal basis for processing these data comes from Article 6.1 subsections c) and f) of the GDPR. Our legitimate interest lies in the correct affirmation and application of legal claims, as well as in the defense against claims filed against us and in the prevention of any harm to our company.
- b) On the other hand, NOEL has the collaboration of third party service providers who may process your personal data exclusively to comply with the purposes indicated in this document, as well as with legal obligations. These third parties act as data processors and will not use your data for their own purposes. They include database management service providers, IT support, human resources management and hiring of personnel.
- SECURITY MEASURES
NOEL and its service providers are committed to processing all personal data provided with the utmost confidentiality, maintaining the duty to secrecy and applying the suitable technical and organsisational security measures, in accordance with current legislation.
These measures guarantee the security of the data and prevent their alteration, loss, unauthorised processing and access, taking into account the state of the technology, the nature of the stored data and the risks to which they are exposed.
- AUTOMATED DECISIONS AND CREATION OF PROFILES
Applicants are informed that there will not be any automated decisions in the selection process.
On the other hand, due to the incorporation of the CV into the selection process and the tests in which you participate, NOEL will create profiles that adapt to the offered job and will proceed with the selection of personnel based on their skills, as well as promotion and/or professional career.
- PRESERVATION DEADLINES
If you are not selected, you give your consent for your data to form part of our community of applicants (generic application). In this case, your data will be deleted one year after ending the selection process, unless you give your consent to keep them for longer. This would allow us to inform you of future vacancies that may be of interest to you. In this case, your data will be kept until you revoke consent and as long as they are suitable, relevant and limited to the fulfillment of the purposes for which they were processed.
Without prejudice to the above, it may be the case that it is necessary to keep your data (blocked), until the expiry of possible liabilities that may arise from the data processing.
With regard to generic applications, the preservation period will be one year, unless you expressly authorise they be kept for longer. In this case, we will keep your personal data until you revoke your consent and as long as they are suitable, relevant and limited to the fulfillment of the purposes for which they were processed.
- EXERCISE OF RIGHTS.
As the data holder, the applicant may exercise the rights recognised in the data protection regulations, at any time and free of charge, by writing to rgpd@noel.es. The applicant has the following rights:
- Right of Access.
You will be entitled to NOEL informing you about whether it is processing your personal data or not and, in that case, to obtain a copy of them, receive information about the purposes of the processing, the affected data categories, the recipients or categories of recipients to whom the personal data are or will be communicated, the envisaged preservation period of the personal data, among other information.
- Right of Rectification.
You will be entitled to request rectification of inaccurate data that concern you.
Bearing in mind the purposes of processing, you will be entitled to the completion of incomplete personal data, including through an additional declaration.
When making the application, you must indicated to which data you refer and the correction that must be done. Furthermore, when necessary, you must attach to your application the documentation that justifies the inaccuracy or incomplete nature of your data.
- Right to deletion (“to be forgotten”).
You will be entitled to request the deletion of your personal data when any of the circumstances envisaged by current legislation occurs.
- Right to object.
You will be entitled to the controller processing the personal data when they are the subject of processing based on a mission of public interest or in legitimate interest, or when the purpose of the processing is direct marketing.
The data controller will stop processing the data unless it proves powerful reasons that prevail over the interests, rights and freedoms of the data subject, or for the formulation, exercise or defence of claims.
Having exercised this right for this purpose, the personal data will stop being processed for this reason.
- Right to limitation of processing.
When you challenge the accuracy of your personal data, while their accuracy is being verified, or when you have objected to the processing of your personal data that the controller does on the basis of legitimate interest or a mission of public interest, while the latter verifies if these reasons prevail over yours, you may request the processing of your personal data be limited, these only being processed for the exercise of defence of claims.
- Revocation of consent.
Likewise, you will be entitled to revoke consent given at any time, for reasons relating to your particular situation, if the processing is based on our legitimate interest or in the legitimate interest of a third party (including processing for the purpose of direct marketing and the creation of the corresponding profiles). In this case, NOEL will cease processing, unless legitimate reasons are proven.
- Portability of your data.
You will be entitled to receive the personal data provided to NOEL in a structured format, of common use, or mechanical and interoperable reading, and to transmit those to another data controller, as long as the processing is legitimised on the basis of consent or within the framework of execution of a contract.
This right will not be applicable when the processing is necessary to comply with a mission of public interest or in the exercise of public powers conferred to the data controller.
Likewise, you may file a claim relating to the protection of your personal data before the Spanish Data Protection Agency (AEPD) at C/ Jorge Juan, 6. 28001 – Madrid, when the data subject deems that NOEL has breached the rights set out in the applicable data protection regulations.
